1. Introduction
Welcome to Shanijyot Agro (https://shanijyotagro.com) Farmers Producer Company Limited (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our products, services, website, and business operations related to the trading and supply of agricultural produce including gram, soybean, toor dal, and onion (collectively, the “Products”).
By engaging in any business, transaction, or communication with the Company, you agree to be bound by these Terms. If you do not agree, please refrain from using our services or purchasing our Products.
2. Business Overview
Shanijyot Agro Farmers Producer Company Limited is a registered Farmers Producer Company (FPC) engaged in the procurement, trading, and distribution of agricultural produce sourced directly from farmers and suppliers.
Our aim is to promote fair trade, transparency, and sustainable agricultural practices while ensuring quality products for buyers and fair value for producers.
3. Products
We trade in the following primary commodities:
Gram (Chana)
Soybean
Toor Dal (Pigeon Pea)
Onion,etc.
All products are sold subject to availability, quality standards, and prevailing market conditions.
4. Pricing and Payment
Product prices are determined based on current market rates, quality grades, and supply conditions.
Prices are exclusive of taxes, unless otherwise specified.
Payment terms must be agreed upon prior to delivery and may include advance payment, partial payment, or credit terms as per mutual agreement.
The Company reserves the right to revise prices without prior notice in case of market fluctuations or regulatory changes.
Payments shall be made through bank transfer, cheque, demand draft, or any approved digital mode.
5. Quality and Inspection
The Company ensures that all products are inspected and graded as per applicable FSSAI, Agmark, or relevant government standards.
Buyers are encouraged to inspect the goods at the time of delivery.
Complaints regarding quality or quantity must be reported within 24 hours of receipt.
Once goods are accepted, the Company shall not be responsible for deterioration, damage, or storage issues.
6. Delivery and Risk
Delivery schedules are subject to availability and logistics conditions.
Risk and title to the goods pass to the buyer upon delivery or dispatch, whichever occurs first.
The Company shall not be liable for delays caused by transportation issues, natural calamities, strikes, or unforeseen circumstances.
7. Returns and Cancellations
Orders once confirmed cannot be cancelled without written approval.
Returns are accepted only in cases of genuine product defects or errors in dispatch, reported within 24 hours of delivery.
Refunds or replacements are processed after due verification and at the Company’s discretion.
8. Compliance and Regulations
All transactions shall comply with applicable Indian laws, FSSAI regulations, agricultural marketing norms, and trade standards.
Both parties shall maintain the necessary licenses, GST registration, and documentation required for lawful business operations.
9. Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the products, including but not limited to loss of profit, delay, or business interruption.
Our total liability shall not exceed the invoice value of the goods in question.
10. Confidentiality
Both parties shall maintain confidentiality regarding pricing, trade information, business operations, and customer data unless disclosure is required by law.
11. Dispute Resolution
Any dispute arising under these Terms shall first be resolved through mutual discussion and negotiation.
If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the arbitration venue at Ahilyanagar, Maharashtra, India.
The courts at Ahilyanagar, Maharashtra shall have exclusive jurisdiction.
12. Force Majeure
The Company shall not be held responsible for failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, war, strikes, government restrictions, or supply chain disruptions.
13. Amendments
Shanijyot Agro Farmers Producer Company Limited reserves the right to modify or update these Terms at any time. Changes will be effective upon posting or communication to stakeholders.
